Article 1 – Scope and Enforceability of the General Terms and Conditions of Sale
These General Terms and Conditions of Sale (hereinafter "the GTC") govern exclusively the sale of our products on the website www.thes-traditions.com (hereinafter "the Site").
By purchasing our products, the buyer fully and unconditionally accepts the GTC. Confirmation of an order on the Site constitutes acceptance of the GTC by the buyer.
Unless proven otherwise, data recorded on the Site constitutes proof of all transactions between our company and the buyer.
The fact that our company does not invoke any clause of the GTC at any given time shall not be construed as a waiver of the right to invoke that clause at a later date. Likewise, any condition contrary to the GTC requested by the buyer and not accepted by our company shall not be enforceable against us.
Article 2 – Orders
Buyers may only place an order online by completing the order form on the Site.
Orders placed on the Site are recorded upon confirmation by the buyer.
However, an order only becomes final once it has been confirmed by our company.
Contractual information and the GTC are presented on the Site in French and will be confirmed by our company no later than at the time of product delivery.
Our company reserves the right to cancel or refuse any order from a buyer with whom a dispute exists regarding payment of a previous order.
Article 3 – Availability and Quantities
Our product offers and their prices are valid for as long as they are visible on the Site, subject to available stock.
In the event that one or more products become unavailable after an order has been placed, except in cases of force majeure as set out in Article 14 below, the buyer will be notified immediately and will have the option to cancel their order. Any sums already paid will be refunded by credit to the buyer's bank account within 30 days of the date of payment.
Article 4 – Prices and Transfer of Ownership
4.1. Product prices are quoted in euros and include handling, packaging and storage costs, but not shipping costs.
For France and European Union countries, prices are inclusive of all taxes (VAT included), with the VAT rate applied being that in effect on the date of the order. Any change in the VAT rate will automatically be reflected in product prices.
Shipping costs depend on the delivery destination, as follows:
- Delivery within mainland France:
Thés & Traditions offers several delivery options:
- Standard delivery to a collection point (local merchant, post office or Cytissimo drop-off point) chosen by the buyer at checkout on the Thés & Traditions website, with a shipping contribution of €4.50 (VAT included). This delivery option is free for orders of €45 or more.
- Standard delivery to the address provided by the buyer, with letterbox drop-off and no signature required, for a shipping contribution of €5.90 (VAT included). This delivery option is free for orders of €45 or more (after discounts).
- Delivery to French overseas territories and international destinations:
All deliveries to French overseas territories and international destinations are automatically processed as "international delivery" in accordance with postal rates in effect on the date of the order.
Outside the European Union, customs duties or import taxes may apply in addition to the price of our products and remain the buyer's responsibility. It is therefore the buyer's responsibility to check the applicable amounts with their local customs office.
4.2. Our company reserves the right to modify product prices at any time. However, products will be invoiced at the rates in effect at the time the buyer places their order.
4.3. Products remain the property of our company until full payment of their price has been received.
4.4. Discounts cannot be combined.
Article 5 – Delivery
5.1 – General
Products are delivered to the delivery address provided by the buyer at the time of ordering.
The buyer is responsible for taking all necessary steps to ensure successful delivery. In particular, the buyer must provide all information required for delivery (exact address, entry code, etc.). Failure to do so means our company cannot be held liable for non-delivery. In such cases, products will be returned to our company's warehouse and the buyer must contact our Customer Service team (contact details provided in Article 10) for instructions on how to retrieve their order. Our company accepts no responsibility for any delay in the buyer collecting their products.
5.2 – Delivery Times
Orders are processed the day after they are recorded.
Orders placed on Saturday or Sunday are processed the following Monday.
Orders placed on a public holiday are processed on the next working day.
If part of an order is unavailable, our company will contact the buyer to offer a replacement for the unavailable product(s). If the buyer declines, our company will either refund the unavailable items or arrange split shipments, according to the buyer's preference. No additional shipping charges will be applied for the remainder of the order.
Products are delivered:
- By Colissimo home delivery (to the address of your choice) for orders to be delivered within mainland France. Delivery typically takes 2–3 working days after dispatch by our company (standard transit time as indicated by La Poste). If the parcel is too large for the letterbox, a delivery notice will be left indicating the post office holding the parcel, where it will be kept for a maximum of 14 days.
- By So Colissimo collection point (local merchant, post office or Cytissimo drop-off point) for orders to be delivered within mainland France. Delivery typically takes 2–3 working days after dispatch by our company (standard transit time as indicated by La Poste). The buyer will receive an email confirming that their order is ready for collection at the collection point chosen at checkout. The order will be held for a maximum of 14 working days. To collect the order, the buyer must present the collection voucher previously sent by SoColissimo in the customer notification email.
- By Colissimo International for orders to be delivered outside mainland France. Delivery times vary by destination country, typically between 3 and 12 days after dispatch by our company (standard transit time as indicated by La Poste).
- By UPS.
If products have not been delivered within 11 days for mainland France, or within 21 days for overseas territories and international destinations, except in cases of force majeure as set out in Article 14 below, the sale may be cancelled by the buyer by registered letter with acknowledgement of receipt sent to our Customer Service team (contact details in Article 10 below). The buyer may then obtain a refund under the conditions set out in Article 8 below, to the exclusion of any other compensation or damages.
Equally, if products have been dispatched after the maximum timeframes referred to above, the buyer may also cancel their order and request a refund for returned products, provided they are complete and in their original condition, accompanied by the original purchase invoice, along with return shipping costs.
In any event, delivery within the agreed timeframes can only take place if the buyer is up to date with all payments due to our company.
5.3 – Delivery Issues
The buyer must inspect the condition of the packaging and verify that the delivered products are as ordered as soon as the parcel is handed over by the carrier.
Any claim regarding non-conformity of delivered products must be notified by the buyer by registered letter with acknowledgement of receipt within 72 hours of receipt, addressed both to the carrier (whose address appears on the delivery note) and to our Customer Service team. A notification may also be sent by email to:

Any claim regarding apparent defects in delivered products must be notified by the buyer within 8 days of receipt by registered letter with acknowledgement of receipt to our Customer Service team, or by email to:
contact@thes-traditions.com.
The buyer is responsible for providing our company with all documentation required to support their claim.
In the event that our company accepts the claim, the buyer will be entitled to the refund or exchange conditions set out in Article 13 below.
If no claim is submitted within the timeframes stated above, the products will be deemed compliant and accepted by the buyer.
5.4 – Order Tracking
Once our company dispatches the ordered products, a confirmation email is sent to the buyer.
This email includes the parcel tracking number and a link to the delivery tracking website.
Article 6 – Payment
- By credit or debit card: Visa, MasterCard and other bank cards. The card is charged at the time the order is placed.
In the event of late or non-payment, our company may suspend all pending orders, without prejudice to any other course of action.
Article 7 – Right of Withdrawal
You have the right to withdraw from this contract without giving any reason within fourteen days. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and indicated by you, physically takes possession of the last item ordered.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired. You will have to bear the direct cost of returning the goods.
Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of any additional costs arising from your choice of a delivery method other than the least expensive standard delivery option offered by us), without undue delay and in any event no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earliest.
Exceptions to the right of withdrawal
The right of withdrawal does not apply to the following contracts:
- contracts for the supply of goods made to the consumer's specifications or clearly personalised;
- contracts for the supply of goods liable to deteriorate or expire rapidly;
- contracts for the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for hygiene or health protection reasons;
- contracts for the supply of goods which, after delivery, are, by their nature, inseparably mixed with other items;
Article 8 – Refunds
Refunds for products in the situations referred to in Articles 5, 7 and 13 will be processed within 14 days of receipt of the returned products by our company.
Refunds will be made, at our company's discretion, by credit to the buyer's bank account. No cash-on-delivery returns will be accepted under any circumstances.
Article 9 – Security
The Site uses a security system. Our company has implemented SSL encryption to protect all sensitive payment data as effectively as possible. Order payments are processed through Banque Populaire.

Article 11 – Intellectual Property
11.1. All visuals, photographs, texts, comments, works, illustrations, drawings and images reproduced on the Site are protected by copyright and intellectual property rights worldwide. Any total or partial reproduction of the Site is strictly prohibited.
11.2. The buyer agrees not to use the products in any way that infringes the rights of our company.
Article 12 – Liability
The products offered on the Site comply with French legislation in force and applicable standards in France.
Product photographs on the Site are provided for illustrative purposes only and have no contractual value. Buyers are invited to refer to the description of each product on the Site to learn about its characteristics. In case of doubt or if further information is required, please contact our Customer Service team at the details provided in Article 10 above.
Article 13 – Warranties
The buyer benefits from the statutory warranties of conformity and against hidden defects in accordance with the legal provisions set out in Appendix A of these GTC.
Accordingly, our company undertakes, at the buyer's discretion, to refund or exchange any products that appear to be defective or do not match the order.
Products must be returned unused, complete, in their original condition (packaging, accessories, etc.) and accompanied by the original purchase invoice.
No product will be refunded or exchanged before it has been returned to and received by our company.
The buyer is responsible for providing our company with all documentation required to substantiate the reported defect or non-conformity.
The buyer must not attempt to repair the product themselves or have it repaired by a third party.
The provisions of this article do not prevent non-professional buyers from exercising their right of withdrawal as set out in Article 7 above.
Article 14 – Force Majeure
Neither party shall be considered to have breached its contractual obligations where performance is delayed, hindered or prevented by an unforeseen event or a case of force majeure. An unforeseen event or force majeure shall mean any fact or circumstance that is irresistible, external to the parties, unforeseeable, unavoidable, beyond the parties' control and which cannot be prevented despite all reasonably possible efforts. The affected party shall notify the other within 7 working days of becoming aware of such circumstances.
Both parties will then meet within 30 days to assess the impact of the event and agree on the conditions under which the order will continue to be performed. If the unforeseen event or force majeure lasts more than 60 days, the product order may be terminated by the affected party. Without limitation, the following are expressly considered as unforeseen events or force majeure, in addition to those ordinarily recognised by French courts: blockage of transport, delivery or supply channels, earthquakes, fires, storms, floods, lightning, and disruption of telecommunications networks.
Article 15 – Applicable Law and Disputes
These GTC have been drafted in French, which shall in all circumstances be considered the sole binding language between the parties. The interpretation and performance of these GTC, as well as all acts arising from or consequent upon them, shall be governed by French law, regardless of the place of delivery, the place where the order is placed, the nationality of the buyer or their address. Any dispute between professionals and/or merchants arising from these GTC and/or any order placed with our company and/or any sale carried out by our company shall be subject to the exclusive jurisdiction of the Commercial Court of Aix-en-Provence, including in cases of warranty claims, multiple defendants or counterclaims.
Article 16 – Personal Data
The information and data relating to the buyer are necessary for the management of their order and their commercial relationship with our company. They may be shared with companies involved in these activities, such as those responsible for the fulfilment, management, processing and payment of orders. This information and data are also retained for security purposes, to comply with legal and regulatory obligations, and to enable our company to improve and personalise the services it offers and the communications it sends to buyers.
In accordance with the French Data Protection Act No. 78-17 of 6 January 1978, the buyer has the right to access, rectify and delete their personal data.
