Article 1 - Application and enforceability of the General Sales Conditions

The present General Terms and Conditions of Sale (hereinafter "the GTC") exclusively govern the sale of our products on the website https://www.thes-traditions.com/en/ (hereinafter "the Site").
Consequently, the fact of buying our products implies the whole adhesion and without reserve of the purchaser to the CGV. Also, the validation by the purchaser of his order on the Site is worth acceptance by this one of the CGV.

Unless proven otherwise, the data recorded on the Site constitutes proof of all transactions between our company and the buyer.
The fact that our company does not avail itself at a given time of any of the clauses of these GTC shall in no case be interpreted as a waiver by our company to avail itself later of any of the said clauses. In the same way, any condition, contrary to the GCS, requested by the purchaser and not accepted by our company is not opposable to us.

Article 2 - Orders

The buyer can only place his order online if he has filled in the order form on the Site.
Orders placed on the Site are recorded as soon as the order is validated by the buyer.
However, the order becomes final only when it has been confirmed by our company.
The contractual information and the GTC are presented on the Site in French and will be confirmed by our company at the latest at the time of delivery of the products.
Our company reserves the right to cancel or refuse any order from a buyer with whom there is a dispute over payment of a previous order.

Article 3 - Availability and quantity ordered

Our product offers and their prices are valid as long as they are visible on our Site, within the limits of available stocks.
In the event of unavailability of one or more products after the placing of the order by the buyer, except in cases of force majeure provided for in Article 14 below, the buyer will be notified immediately and will have the opportunity to cancel the order. The reimbursement of the sums paid will then be carried out by credit on the bank account of the purchaser within 30 days as from the payment of the price by the purchaser.

Article 4 - Price - Transfer of ownership

4.1. The prices of the products are indicated in euros and include the expenses of handling, packing and conservation of the products but not the expenses of forwarding.
For France and the countries of the European Union, the prices are inclusive of all taxes (TTC), the VAT applied being that of the day of the order. Any change in the VAT rate will be automatically reflected in the price of the products.
The shipping costs of the products depend on their place of delivery, namely :

  • Delivery in France:

Thés & Traditions offers several delivery methods:

- standard delivery in a relay point (retailer, post office or cytissimo space) that he will indicate when ordering on the website Thés & Traditions, the buyer must pay 4.50€ (including VAT) for shipping costs. From 45 € of purchase, this mode of delivery is offered.

- standard delivery to the address he will take care to indicate, with a delivery in letter box without signature for a participation of the buyer of 5€90 TTC in the shipping costs. From 45 € of purchase (discounts deducted), this mode of delivery is offered.

  • Delivery in the DOM - TOM and abroad:

Any delivery in the DOM - TOM and abroad is systematically treated in "international delivery" according to the postal rates in force at the day of the placing of the order.
Outside the European Union, customs or import taxes may be added to the price of our products and remain the responsibility of the buyer. It is therefore the responsibility of the buyer to find out the amount of these taxes from his local customs office.

4.2. Our company reserves the right to modify the price of the products at any time. However, the products will be invoiced on the basis of the rates in force at the time of the placing of the order by the purchaser.

4.3. The products remain the property of our company until full payment of their price to our company.

4.4. Discounts are not cumulative.

Article 5 - Delivery

5.1 - General information

The products are delivered to the delivery address indicated by the purchaser at the time of his order.
The buyer is required to take all necessary steps to ensure the delivery is carried out correctly. As such, it is required to provide all information necessary for delivery (exact address, door code etc.). Otherwise, our company cannot be held responsible for a failure to deliver. In such a case, the products will be returned to the warehouse of our company and the buyer will have to contact our Customer Service whose coordinates are indicated in article 10 in order to take note of the steps to follow to recover the ordered products. Our company declines any responsibility as for the delay of recovery by the purchaser of his products.

5.2 - Deadlines

Orders are processed the day after they are placed.
Orders placed on Saturday or Sunday are processed the following Monday.
Orders placed on a holiday are processed the next business day.
If the totality of the order is not available, our company will contact the purchaser to propose to him to replace the unavailable products by one or more other products. In case of refusal of the buyer, our company will proceed either to the refunding of the unavailable products or to split shipments, according to the choice of the buyer. For the balance of the order, the shipping costs will not be charged.

The products are delivered :

  • or by Colissimo Domicile (delivery to the address of your choice) for orders to be delivered in metropolitan France.the time generally noted for the delivery of products is 2-3 days after the processing and shipment of the package by our company (normal delivery time given by the Post Office). It is possible to find a notice of passage when the parcel is too large to be deposited in the mailbox, it will indicate the post office that will keep the package for 14 days maximum.
  • or in a So Colissimo relay point (shop, post office and Cytissimo space) for orders to be delivered in metropolitan France. The time generally noted for the delivery of the products is 2-3 days after the treatment and the forwarding of the parcel by our company (normal time of routing given by the Post office). The buyer will receive an email confirming the availability of his order at the relay point he will have previously chosen when ordering. The order will be kept for a maximum of 14 working days by the parcel relay. To retrieve the order, the buyer will have to present the withdrawal form previously transmitted by SoColissimo in the customer notification email.
  • or by Colissimo International for orders to be delivered outside metropolitan France. The time generally noted for the delivery varies according to the recipient countries between 3 and 12 days after the treatment and the forwarding of the parcel by our company (normal time of routing given by the Post office).
  • or by UPS

If the products have not been delivered within 11 days for Metropolitan France and within 21 days for the DOM TOM and abroad, except in cases of force majeure as provided in Article 14 below, the sale may be cancelled by registered letter with return receipt requested sent by the buyer to the Customer Service whose coordinates are indicated in Article 10 below. The buyer will then be able to obtain restitution of his payment under the conditions provided for in article 8 below, to the exclusion of any other compensation or damages.
Likewise, if the products have been shipped after the maximum time period referred to in the above paragraph, the buyer may also cancel the order and request a refund of the products returned complete, in their original condition, accompanied by the purchase invoice, as well as the return costs.
In any case, the delivery within the time limit can only take place if the buyer is up to date with his payments to our company.

5.3 - Delivery problems

The buyer is required to check the condition of the packaging and the conformity of the products delivered as soon as the package is handed over by the carrier.
Any complaint for non-conformity of the delivered products must be notified by the purchaser, by registered letter with request for acknowledgement of receipt, within 72 hours following its reception, both to the carrier whose address appears on the delivery note and to the Customer Service of our company. Any complaint on the apparent defects of the delivered products must be notified by the purchaser within 8 days following their reception by sending a registered letter with acknowledgement of receipt to the Customer Service of our company or an e-mail to the following address

It will be up to the buyer to provide our company with any justification necessary for his claim.
In the event that the complaint is accepted by our company, the buyer will be able to benefit from the conditions of reimbursement or exchange provided for in Article 13 below.
In the absence of a complaint made within the above-mentioned time limits, the products will be deemed to be in conformity and accepted by the buyer.

5.4 - Order tracking

As soon as our company proceeds with the shipment of the ordered products, an e-mail is sent to the buyer.
It is indicated to the buyer the number of his parcel and a link is proposed to him towards the Internet site of follow-up of his delivery.

Article 6 - Payment

  • By credit card: Visa, MasterCard and other blue cards. The card is debited as soon as the order is placed.

In case of delay or default in payment, our company may suspend all outstanding orders, without prejudice to any other course of action.

Article 7 - Right of withdrawal

You have the right to withdraw from this contract without giving any reason within fourteen days. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last item.

In order for the withdrawal period to be respected, it is sufficient for you to send your communication regarding the exercise of the right of withdrawal before the expiration of the withdrawal period. You must bear the direct costs of returning the goods.

Effects of withdrawal

In the event of your withdrawal from this Agreement, we will refund all payments received from you, including delivery charges (except for any additional charges arising from the fact that you have chosen a delivery method other than the cheaper standard delivery method offered by us) without undue delay and in any event no later than fourteen days from the day we are informed of your decision to withdraw from this Agreement. We will make the refund using the same payment method you used for the original transaction, unless you expressly agree to a different method; in any case, this refund will not incur any costs for you. We may defer the refund until we have received the goods or you have provided proof of shipment of the goods, whichever comes first.

Exception to the right of withdrawal

The right of withdrawal is excluded for the following contracts:

  • contracts for the supply of goods made to the consumer's specifications or clearly personalized;
  • contracts for the supply of goods that are likely to deteriorate or expire rapidly;
  • contracts for the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;
  • contracts for the supply of goods which, after delivery, are by their nature inseparably mixed with other articles;

Article 8 - Refunds

The refund of the products in the hypotheses referred to in articles 5, 7 and 13 will be carried out within a time lower or equal to 14 days following the reception of the returned products by the purchaser.

The refund will be made, at the choice of our company, by crediting the bank account of the buyer. No cash on delivery will be accepted for any reason whatsoever.

Article 9 - Security

The Site is subject to a security system. Our company has adopted the SSL encryption process in order to protect all sensitive data related to payment methods as effectively as possible. The payment of the orders is carried out by the intermediary of the popular bank.

Article 11 - Intellectual Property

11.1. All visuals, photos, texts, comments, works, illustrations, drawings and images reproduced on the Site are subject to copyright and intellectual property rights for the whole world. Any total or partial reproduction of the Site is therefore strictly forbidden.

11.2. The purchaser undertakes not to use the products in such a way as to infringe the rights of our company.

Article 12 - Liability

The products offered on the Site comply with current French legislation and standards applicable in France.
The photographs of the products on the Site are provided for illustrative purposes and therefore have no contractual value. The buyer is invited to refer to the description of each Product on the Site to know its characteristics and in case of doubt or if additional information is required, to contact the Customer Service whose coordinates are given in article 10 above.

Article 13 - Guarantees

The buyer benefits from the legal guarantees of conformity of the good to the contract and from hidden defects in accordance with the legal provisions specified in appendix A of the present GTC.
Thus, our company undertakes, at the choice of the buyer, to refund or exchange the products apparently defective or not corresponding to his order.
The products must be returned to us new, complete, in their original condition (packaging, accessories ...) and accompanied by the original purchase invoice.
No product can be refunded or exchanged until it has been returned and received by our company.
It will be up to the buyer to provide our company with any justification as to the reality of the anomalies or defects.
He will not intervene himself or have a third party intervene for this purpose.
The provisions of this article do not prevent the non-professional buyer from benefiting from the right of withdrawal provided for in article 7 below.

Article 14 - Force majeure

Neither party shall have failed in its contractual obligations to the extent that their performance is delayed, hindered or prevented by an act of God or force majeure. A fortuitous event or force majeure shall be considered to be any irresistible fact or circumstance, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts. The party concerned by such circumstances shall notify the other within 7 working days following the date on which it becomes aware of them.
The two parties will then meet within 30 days to examine the impact of the event and agree on the conditions under which the execution of the order will be continued. If the fortuitous event or the case of force majeure lasts longer than 60 days, the order of products may be terminated by the injured party. Expressly, the following are considered as fortuitous events or cases of force majeure in addition to those usually retained by the jurisprudence of the French courts and tribunals: the blocking of means of transport, delivery or supplies, earthquakes, fires, storms, floods, lightning, the stoppage of telecommunication networks.

Article 15 - Applicable law - Disputes

The present GTC have been written in French language which will be considered, in any hypothesis, as the unique language of the parties. The interpretation and execution of these GTC, as well as all the acts which would be the continuation or the consequence, will be subjected to the French law and this, whatever the place of delivery of the products, the place of placing of order, the nationality of the purchaser and his address. Any dispute with professionals and/or traders resulting from the present GTC and/or any order addressed to our company and/or any sale made by our company will be subject to the exclusive competence of the Commercial Court of Dijon, even in the event of a guarantee appeal or multiple defendants or incidental demand.

Article 16 - Personal information

The information and data concerning the buyer are necessary for the management of his order and his commercial relations with our company. They can be transmitted to the companies which contribute to these relations such as those in charge of the execution of the services and orders for their management, execution, treatment and payment. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations, as well as to allow our company to improve and personalize the services it offers and the information it sends to buyers.
In accordance with the French law "Informatique et Libertés" n° 78-17 of January 6, 1978, the purchaser has a right of access, of correction and suppression of the personal data concerning him. Depending on the choices made when purchasing products, the buyer may receive offers from our company, as indicated during the ordering process.
